A Texas man is recovering from an accident which caused serious injuries to him and killed two others. The man responsible for the accident was drunk at the time of the accident, with a blood alcohol level 2.5 times the legal limit.

The victim of this accident has undergone 20 surgeries to recover for the injuries sustained.

Punitive damages are available in Illinois in cases where the defendant showed a conscious and reckless disregard for the safety of others.

Permission from the court is required before an injured party can seek punitive damages. However, in cases involving drunk drivers, this is almost always granted.

Anyone who gets on the road with a blood alcohol level as high as the responsible driver in this case did has to be aware that they are not fit to drive. When they decide to get behind the wheel in that state, they are making a conscious decision to put the safety of others at risk. This kind of situation clearly warrants punitive damages.
