A 10 year old Texas girl has died after being mauled by a pit bull. The dog had escaped the yard where it was kept by jumping a fence. In addition to attacking the girl, the dog also bit two men who tried to rescue the dog.

The girl died from blood loss resulting from puncture wounds to the neck.

Victims of dog attacks in Illinois have two main avenues of recovery: (1) a statutory claim under the Animal Control Act and (2) a common law negligence claim. In addition, in cases such as this where the animal escapes and is running free, there may also be a statutory claim under a law called the Domestic Animals Running at Large Act. The essential elements of proof are similar to the other claims and the Act does not permit duplication of damages, but it is another important avenue to ensure that victims of animal attacks are able to recover.
