Man Suing Jail over Slip & Fall

An inmate at South Central Regional Jail in Charleston is blaming the jail for his slip and fall down a flight of stairs. Nalone Stallings is suing the Jail and Correctional Facility Authority, having filed his complaint November 27th in Kanawha Circuit Court that alleges his injuries is the authority's fault.

Stallings, of Charleston, says he "sustained bodily injuries as a result of a slip and fall accident on the property of the defendants." A puddle of water was left on the floor and Stalling slipped in it and then proceeded to "fall down a flight of steps," the complaint adds.

Stallings, is also making a claim for punitive damages for his physical pain and suffering, mental anguish, limited activities and diminution in his ability to enjoy life, he seeks compensatory damages.

The alleged incident took place Dec. 5, 2004. Geoffrey Ekenasi of Twyman Law Offices is representing Stallings.

"At the time of his fall, the plaintiff... was exercising ordinary care to avoid such a hazard," the complaint says.

He adds that the Regional Jail and Correctional Facility Authority violated his Eighth Amendment right to be protected.
