Several workers on a road construction project on Route 161 in Belleville were injured when a pick up truck left the roadway and hit an embankment where work was ongoing.

At least three workers on the project were injured, one of whom suffered head injuries.

On any road construction project, the general contractor has an obligation to ensure that the traffic flows are properly redirected from the work zone and that adequate protection is put into place for the workers on the site. A failure to do so leaves the general contractor liable for injuries sustained by employees of subcontractors and state employees who are injured as a result of inadequate traffic controls.

Further, drivers who go out of control on a work site as happened here may be susceptible for claims for punitive damages, especially given the state's strong policy of protecting workers on road construction projects.
